bad modem or throttled unlimited plan

Am receiving terrible download speeds on an unlimited plan. understand that you prioritize other people but it is stated that when the network isn't congested i shouldn't see any reduction in speeds. i have not been able to get over .30 download from 10 am 3/17/2018 to present which is 1.00am 3/18/2018. This seems like a hard throttle and not what was told to me. Is there something wrong with my modem or are you just throttling my internet that hard? have already spoken to customer support and they recommended i reset my modem, which i did following their reset protocol.

This is a common speed for me on beam 367 from 5 pm through 7 am whether I have "Priority Data" left or not (I am over my current alotment presently) I am lead to believe it is due to congestion, but also lead to believe things were to get better once Viasat 2 takes some of the load off.... so I wait .. and wait
