What to do with old equipment after an upgrade: Answered

There was a thread a week or so ago in which a customer asked what they should do with their Viasat 1 equipment after they upgraded to the Viasat 2 system. Seems like I remember the prevailing thought being that they did NOT need to return the equipment, it was stated that the only time they would have been required would have been if they were cancelling service. 
Well yesterday I got an email from Viasat because there was obviously some confusion on this matter. I'm going to post the main body of the email because it could cause a customer a lot of issues. Here goes: 
"....we would like to remind all technicians that if a customer is upgrading equipment, it is the customer’s responsibility to return their old modem and TRIA to us. Do not take the equipment with you as it can result in an unreturned equipment fee for the customer, up to $335. If the equipment is taken from the customer's property, chargebacks may be applied.
If the customer asks, remind them they will be sent a pre-paid box to return the equipment in."

Well...I will give you this. Viasat is consistent at being non consistant. Wasnt it awhile ago stated on here that when upgrading equipment did not need returned?

Seems like it was just a week or so ago....that's why this email got my attention. Whichever customer it was who was told to not return their equipment might better take a screenshot of that thread.
Time flies... it was this one (in the event anyone else might have fallen for the trap):
