The Tech just left here after installing a new modem. He was a very nice man. 
He answered my questions, setup the modem, stayed with me for the speed checks, and performance.  All seems to be working fine as of the moment. Oh and by the way he was on time. His GPS got him lost and I had to go pick him up but no problem....
I forgot his name already, but he is from Poland and came here from Wisconsin. 
Thanks to him for coming today.

Glad to hear things are working now. So it sounds like it was the modem that was causing the slow speeds.

Well Joshua I thought the same but today my speeds are really bad. I did a check and got  4.5 down and 3.2 up so there is still a problem and I think it's on the other end. Even last night about 2:00 am it was slow. I think I will call support tomorrow and see if they can do anything about it on there end.. This is the best I have done since the new modem install .

Just out of curiosity, have you tried doing these tests plugged straight into your modem? That's the only other thing I could think of to rule it out. Otherwise, it just sounds like your region is overloaded.

Remember the advertised speeds are "Up To." Actual speeds vary widely depending on your beam and geographic location. Your speeds of 4.5 and 7.85  are pretty typical for congested beams. There are a lot of Exede and Hughes customerw who would really love to have those speeds most of the time.

Yes I have went straight into the modem and had no change. I also bought a new router.

From what I see in your post with the Up To could cover anything from dialup to good speeds. That's a rather broad area wouldn't you say? I would like to know just how many are on this beam I am on.

I understand this but some of them are at 2-3:00am and same results. Well if they are getting less it's up to them to keep saying something about it. I mean if my speeds were much lower than this I would either demand they fix it or I would leave the service because of the no holding there end of the agreement. Period.
I mean $120.00 bucks a month should give you great speeds and service.

I just tried and  got the same thing. They appear to be down right now. I always use testmy.net it works much better for me and gives more consistent results.
